The IRS and individuals will use the information provided under Section 6055 to administer the ACA’s individual mandate. Part II, Line #22, Box C and Part III, Column – Box C and Column continue to reflect two forms of transition relief.
Employers who offer an employer-sponsored self-insured plan also use Form 1095-C to report information to the IRS and to employees about individuals who have minimum essential coverage under the employer plan. Form 1095-B is used to report certain information to the IRS and to taxpayers about individuals who are covered by minimum essential coverage and therefore are not liable for the individual shared responsibility payment. When explaining the ACA’s filing requirements, we found it helpful to point to the similarities between the payroll reporting on IRS Form’s W-2 (“Wage and Tax Statement”) and W-3 (“Transmittal of Wage and Tax Statement”), and the Forms 1094-B and 1095-B and Forms 1094-C and 1095-C .

An ALE Member is not required to make an entry on line 16 of Form 1095-C. However, an ALE Member may use line 16 to indicate that the ALE Member qualifies for an exception from a potential assessable payment under section 4980H for a given month. Thus, an ALE Member should enter the appropriate code on line 16 if any applies.

Form W-2 is familiar to taxpayers of all stripes as the form that employers provide to them in connection with the filing of their annual Form 1040 (“U.S. Individual Tax Return”), and employers recognize Form W-3 as the form they use to provide copies of W-2s to the government. Forms 1094-B and 1095-B, and 1094-C and 1095-C, operate in a similar fashion. Forms 1095-B and 1095-C are individualized forms that are provided to employees, and Forms 1094-B and 1094-C are used to transmit information reflected on Forms 1095-B and 1095-C to the government. Code 1D – Offered minimum value coverage to the employee and at least minimum essential coverage to the spouse (but not to the employee’s dependent children).
By collecting 1095-C forms, the IRS can track who is and isn’t making coverage available to workers. If a mid-size employer meets the requirements of transition relief, it should check Box C. To correspond with this relief, it will also enter the letter “A” in Part III Column of the 1094-C. Two new codes, 1J and 1K, have been added to line 14 to report on conditional offers of coverage to an employee’s spouse. ALEs not in compliance with the coverage provisions are subject to the ACA’s employer penalty, which could be as high as $2320 per employee for 2018. Large Employer Reporting– all applicable large employers must report to the IRS on the medical coverage they offer in compliance with the employer mandate. There are two distinct sets of reporting requirements to help the Internal Revenue Service administer compliance with the employer and individual mandates – the Large Employer Reporting and Minimum Essential Coverage Reporting requirements. It’s important to understand the impacts of these responsibilities because they vary based on group plan size and how plans are insured or funded. Applicable Large Employer Members (ALE – employers with 50 or more FT employees in the previous year are required to file Form 1095-C. Every employee of an ALE who is eligible for insurance coverage should receive a 1095-C. However, a reporting entity that is reporting under Section 6055 as an ALE will file under a combined reporting method, using Forms 1094-C and 1095-C. As part of this combined reporting method, Form 1095-C will be used by ALEs to satisfy both the Section 6055 and 6056 reporting requirements, as applicable.
